Last updated: 13.06.2026

DNS Cloud employs a team specializing in infrastructure, communications, information security and more. Much more information about DNS Cloud, its activities and its various services is available on the DNS Cloud website.

These General Terms ("the Terms") are an integral part of the order form, price quote or any other engagement document ("the Order Form") entered into between you ("you" or "the Customer") and DNS Cloud – regarding the provision of DNS Cloud services, as agreed between you and DNS Cloud in the Order Form ("the Services") – and together with the Order Form, the Terms constitute a binding agreement between you and DNS Cloud for the provision of the Services.

If you do not agree to the Terms and wish to avoid entering into a binding agreement with DNS Cloud, you will not be able to receive the Services from DNS Cloud. The Customer details are as set out in the Order Form.

The Terms are written in the masculine form for convenience only, but they are intended for women and men alike and apply equally to all genders, all sectors and every type of legal entity. Please read the Terms carefully, as engaging with DNS Cloud for the provision of the Services constitutes acceptance of them. Anyone who does not agree to the Terms, or does not wish to enter into a binding contract with DNS Cloud, will not be able to receive or renew the Services from DNS Cloud.

DNS Cloud may, at its discretion, suspend or cancel at any time the Services provided to you under these Terms and the Order Form, in whole or in part, if it believes they are being misused, used in breach of the Terms or in breach of the law, including for reasons of stability and information-security and cyber risks.

Marketing Information and Direct Mail – You hereby give DNS Cloud your explicit consent to receive advertising and direct mail, as this consent is defined in Section 30A of the Israeli Communications Law (Telecommunications and Broadcasting), 5742-1982, and in the Israeli Privacy Protection Law, 5741-1981. These messages, including marketing messages, newsletters, surveys and the like, will be sent to you according to the contact details you provided to DNS Cloud and as kept in the DNS Cloud customer database, by any means that allows sending such messages, existing or future. At any time you may withdraw your consent and notify DNS Cloud that you refuse to receive marketing messages, in general or of a specific type, by sending a refusal notice. The way to send the refusal notice will be specified in the messages. DNS Cloud may at any time send the Customer operational messages regarding its services to the Customer

1.    Definitions – In these Terms, the following terms shall have the meanings set out beside them:

1.1  "the Website" – one or more websites of the Customer on the World Wide Web or any other digital asset of the Customer.

1.2  "the Agreement" – these Terms and the Order Form.

1.3 "Computer" – a server computer connected to the internet, managed by DNS Cloud for the purpose of providing the Services, held by DNS Cloud or a third party on its behalf, in Israel or outside Israel.

1.4 "Domain Name" – the domain name of the Website.

1.5 "the Content" – a computer file of any kind uploaded to the Website via an FTP (File Transfer Protocol) address allocated by DNS Cloud to the Customer, or any other management or content-transfer interface provided by DNS Cloud to the Customer.

Hosting
2. Subject to full and accurate fulfillment of the Customer's obligations, DNS Cloud will install and maintain the Website on a Computer, to the extent and for the period agreed by the parties in the Order Form.

A website whose installation requires special requirements, at the discretion of DNS Cloud (for example, installing DLL files on the Computer), will be installed on a computer dedicated to such websites. Due to the nature of such special requirements, if any, the computer may be more sensitive to information-security risks. You will have no claim, suit or demand against DNS Cloud in connection with such limitations.

Unless otherwise agreed between you and DNS Cloud, explicitly and in writing, responsibility for securing the Website itself, its code, its management interfaces, and for taking all actions required to prevent unauthorized access to the Website,
its systems, content and databases – lies with the Customer, and you must make sure you take all actions
required to protect and secure the Website – in addition to the actions DNS Cloud regularly takes to secure its website hosting systems and its other systems used to provide the Services.

You will have no claim, suit or demand against DNS Cloud regarding the security of the Website or any damage, direct or indirect, that may be caused to you or to third parties if you have not met this obligation. Please consider information-security aspects when developing the Website and be sure to consult the appropriate professionals regarding the obligations that apply to you as a website operator, including information security, accessibility and more.

If the Website includes processing of credit card transactions, or any other similar means, you must make sure and ensure that the Website complies with the PCI DSS standard (the card companies' standard for secure card processing), or any other relevant standard.

3. Uploading and updating content on the Website from time to time will be performed by the Customer and under the Customer's sole responsibility, using an FTP address and matching password allocated by DNS Cloud, or any other similar arrangement. DNS Cloud does not update content on its customers' websites; it only hosts the Website. Keep the password confidential and secure and do not transfer or disclose it to any third party who is not an authorized person on your behalf to access the Website and its content. DNS Cloud may change the password from time to time and set other and additional security measures.

4. If you ask to install applications or technological tools on the Website, or to perform actions that are not part of hosting the Website or of the Services provided to you, you undertake to pay DNS Cloud the fee it charges from time to time for such actions.

If the Website is based on a WordPress content management system, you hereby approve and authorize DNS Cloud to update on the Website plugins intended for such websites, mostly intended to speed up the Website's performance and for security purposes, including the wp-rocket plugin, which is designed to speed up the Website. If you do not want such plugins installed, you must notify DNS Cloud and it will refrain from installing them.

The plugins are usually installed under a license granted to DNS Cloud, and therefore you must remove the plugins whenever you stop using DNS Cloud services under these Terms. You will have no claim, suit or demand against DNS Cloud for installing or not installing such plugins, and you are aware that installing the plugins is at the discretion of DNS Cloud, subject to a compatibility check it will perform and to its professional judgment.

5. Requests to make changes to the hosting of the Website, or to technical aspects of its operation that are under DNS Cloud's control, or to any of the ancillary services you ordered (including migration of the Customer's website, its content and the database it uses), shall be submitted to DNS Cloud in writing and in advance. DNS Cloud will respond to the request as far as possible. If the change involves payment, its actual execution will be subject to payment of the fee. If the requested change requires moving the Website's DNS pointing to DNS Cloud, you hereby authorize DNS Cloud to perform on your behalf and in your place any action required for this transfer and to sign any document required for this purpose.

Website Content

6. Full and exclusive responsibility for the content on the Website lies with the Customer alone. DNS Cloud will bear no responsibility for the content. You undertake, as a fundamental condition, not to include, upload or transfer to the Website content, and not to use DNS Cloud services to display content, of the following types:

6.1 Any content that harms or infringes the proprietary rights of others – including intellectual property rights, domain names or trade secrets;

6.2 Any pornographic or sexually explicit content;

6.3 Any content concerning minors that identifies them, their personal details, their address or ways to contact them – except lawful publication made with the consent of the legal representatives of each such minor;

6.4 Any computer software, computer code or application that includes a computer virus, including hostile software known as 'Trojan horses', 'worms', 'vandals', malicious applications and the like.

6.5 Passwords, usernames and other details that allow using computer software, digital files, websites or services that require registration or payment, without such payment or registration;

6.6 Any illegal content, or content that encourages, supports, assists, provides instructions for or guides the commission of an act constituting a criminal offense;

6.7 Any content that defames a person, or violates their privacy or their right of publicity;

6.8 Any content whose publication is prohibited by law, including content subject to gag orders;

6.9 Any threatening or racist content, or content that may form the basis of a civil claim or constitutes another breach of the law;

6.10 Any content that may mislead consumers;

6.11 Any content encouraging participation in prohibited games, gambling and lotteries prohibited under Israeli law, as well as any content related to pyramid schemes;

6.12 Any content that may cause damage or harm to internet users in general and to DNS Cloud customers in particular.

7. The Customer declares and confirms that it is the owner of, or holds all the required permissions for, all intellectual property rights, and in particular copyrights, in the Website, including the Website code and the content included in it. The Customer declares and confirms that there is no legal, contractual or other impediment to its entering into this Agreement with DNS Cloud.

8. DNS Cloud's hosting services are limited to hosting the Website and placing it on the internet. DNS Cloud does not provide website promotion (SEO) services and bears no responsibility for responses received as a result of displaying the Website on the internet, or for any other service it provides or content it displays. DNS Cloud will not be liable to you, or to any other third party, for liability arising from the activity of the Website and its content.

9. If you asked DNS Cloud to point the Website's domain name to another computer not owned by DNS Cloud, you will be solely responsible for any consequence of the transfer. In this case you undertake, among other things, to take at your own expense every action required to ensure continuity of the Website's activity, including delivery of email to it and every other aspect.

Ancillary Services

10. DNS Cloud provides additional ancillary services, some free of charge to its customers and some subject to additional payment – all as detailed in the Order Form and as agreed between DNS Cloud and the Customer. The scope of the ancillary services DNS Cloud will provide and the fee charged for them will be determined from time to time by DNS Cloud, at its sole discretion.

11. Statistics – DNS Cloud is not responsible for the accuracy of the statistical analysis presented to you by statistics software used on the Website. This service, to the extent provided to you by DNS Cloud, is provided AS IS and you will have no claim, suit or demand against DNS Cloud regarding this service, its accuracy, its reliability or any other related aspect.

12. Email – to the extent agreed by the parties, DNS Cloud will provide the Customer, subject to pointing the Website's DNS to DNS Cloud, with email mailboxes in the scope, quantity, size and terms set out in the Order Form. As part of these services, the Customer undertakes:

12.1 Not to use the service to send unsolicited commercial email (unsolicited mail), send mail to distribution lists, send chain letters, "spam" and the like. Use of DNS Cloud services will be in accordance with the law, including any provision regarding privacy, spam and mailing to recipients who have given their consent;

12.2 Not to use the service to send messages or content (including attachments) that is illegal, false, harmful, threatening, encourages the commission of a criminal offense, or may form the basis of a claim, criminal charge, or civil or administrative liability – including any content that violates privacy or is defamatory;

12.3 Not to send any content that infringes intellectual property rights or other rights of third parties, including copyrights, patents and trademarks;

12.4 Not to transfer any content containing 'viruses', 'Trojan horses', 'worms' or any other harmful application of any kind;

12.5 Not to perform through the service any act that may disrupt the proper operation of any computer systems, and in particular the computer systems of DNS Cloud or any of its customers, suppliers or business partners;

12.6 Not to create a false identity or a fake email address, or include misleading details in any material sent through the service;

12.7 The Customer is aware that DNS Cloud provides its customers with email filtering services (Anti-Spam / Anti-Virus)

for email mailboxes on DNS Cloud servers. You are aware and confirm that an email message

sent to the Customer, or anyone on its behalf, may sometimes be classified as an offensive message or as "spam", and therefore such a message may not reach the relevant mailbox and may be blocked. You will have no claim, suit or demand against DNS Cloud in this matter.

12.8 The Customer will bear full responsibility for the content of its messages and for all consequences arising from these messages and from the use of DNS Cloud email services. Without derogating from the generality of the liability section below –

12.8.1 DNS Cloud will not be liable for messages you receive or send, their content, or any file attached to them, the operation of any such file and its effect on any computer or system of the Customer or any other third party, nor for any damage, loss, inconvenience, distress or any other consequence, direct or indirect, caused to the Customer, anyone on its behalf or any other third party – due to messages received or sent through the service;

12.8.2 DNS Cloud will not be liable for any damage caused to you as a result of using the service – including for interruptions (temporary or permanent) in the service, the cost of an alternative service, loss of messages sent to you or by you (including due to a message being classified as "spam" or not reaching the mailbox due to any similar classification), unauthorized access to the Customer's mailboxes, and any harm or disruption to the integrity or content of messages or data you received or sent, including their loss;

12.8.3 DNS Cloud is not responsible for any use made by a third party of the Customer's email details.

13. Backups – DNS Cloud will provide the Customer, at its request, with backup services for the Website. The backup size, frequency, storage location and other aspects will be as agreed by the parties in the Order Form. If the Customer breaches its obligations under this Agreement, and in particular the obligation to pay for the Services, and does not cure the breach in accordance with this Agreement, DNS Cloud may delete the Customer's backups and not keep any additional copy of them.

If the Customer did not order backup services from DNS Cloud, the Customer undertakes to continuously and regularly keep an updated, independent copy of the Website, by itself or through the backup services of any third party, including all files and data on the Website, and confirms that it will have no claim, suit or demand against DNS Cloud for any loss of such files and data, for any reason whatsoever. Where possible, to the extent DNS Cloud is able to do so and as agreed between you and DNS Cloud, DNS Cloud may provide you with restore and disaster-recovery services, for a fee.

14. Additional Services – DNS Cloud will provide you, at your request, with additional services it may offer, such as access to a secure server (SSL), a database, a control panel, and filtering services for email traffic (Anti-Spam / Anti-Virus). DNS Cloud may charge an additional fee for these services. The services are provided AS IS and you bear full and exclusive responsibility for their use and for any consequence arising from it.

AI Assistant and Support Bot

14A. DNS Cloud makes available to the Customer tools based on artificial intelligence (AI), including a chat assistant on the website and an automatic reply bot in the support ticket system ("the AI Tools").

14A.1 Use of the AI Tools is for the Customer's convenience only. Answers are generated automatically, are provided AS-IS, and may be inaccurate, partial or wrong. Answers from the AI Tools must not be relied on as binding, professional or legal information, and they do not bind DNS Cloud. For any material matter — billing, cancellation, malfunction or data — the Customer may contact a human representative, and the human representative's answer is the one that prevails.

14A.2 The Customer is fully responsible for any content and information it provides or enters into the AI Tools, including personal information — its own or that of a third party. The Customer declares that it is entitled to provide this information and that, where it is a third party's information, it has obtained that party's consent. Providing personal information to the AI Tools is at the Customer's sole responsibility, and it is recommended not to enter sensitive or personal information that is not necessary for the request. DNS Cloud will not be liable for any consequence arising from information the Customer chose to enter into the AI Tools. All the restrictions in Section 6 apply to content entered by the Customer.

14A.3 In order to provide answers, DNS Cloud processes the Customer's input (chat messages and support ticket content). Processing may be performed by a third-party AI provider, with whom the input and output may be stored temporarily for the purpose of operating the service. Processing of personal information in the AI Tools is subject to the Privacy Policy appendix.

14A.4 DNS Cloud does not use the Customer's input to train or improve artificial intelligence models.

14A.5 The limitation of liability in Section 23 applies in full to the AI Tools and to any of their output.

Fees and Payments

15. In consideration for the Services, you undertake to pay DNS Cloud the fee agreed between the parties in the Order Form. DNS Cloud may change, update, increase or reduce the fee for its services from time to time, and you will have no claim, suit or demand against it in this regard. VAT will be added to all payments as required by law.

16. You will not be entitled to any refund of payments you have paid, or undertook to pay, to DNS Cloud, even if you did not actually use the Services, unless the parties have explicitly agreed otherwise.

17. As long as the fee has not been paid to DNS Cloud to its satisfaction, or if payment of the fee has not been secured to its satisfaction, DNS Cloud will not provide the requested Services and may suspend or stop providing the Services. Non-payment of agreed payments constitutes a fundamental breach of the Agreement. In such a case DNS Cloud will be entitled to immediately cancel the Agreement, remove the Website from the Computer or block access to the Website, and where possible DNS Cloud will notify you in advance.

18. Without derogating from DNS Cloud's rights under this Agreement and any law, any payment not paid on time will bear full linkage differences to the Consumer Price Index, plus annual interest at a rate of 12%, compounded on the linked principal every three months – all from the date on which the payment was due to DNS Cloud until the date of its actual full payment.

19. To make payment you must hold a valid credit card that can be processed in Israel. You authorize DNS Cloud to charge the credit card whose details you provided for the Services you purchase or their renewal, and to indemnify DNS Cloud for any expense and/or payment incurred by it due to your acts or omissions, as detailed in these Terms.

20. Payment may also be made by transfer to DNS Cloud's bank account. To do so, contact DNS Cloud by phone, send it the appropriate commitment form that will be sent to you, signed by you, and make the bank transfer accordingly. Payment in this way is possible only for advance payment for a period of 3 months of service or more, unless otherwise agreed between the parties.

Liability

22. DNS Cloud services to its customers are provided AS IS. You declare and confirm that before entering into this Agreement you examined the Services, their capabilities and limitations and found them suitable for your needs. You waive any claim, suit or demand against DNS Cloud regarding the suitability of the Services for your needs. Use of DNS Cloud services is therefore at your sole and full responsibility. You may of course consult professionals on your behalf to make sure the Services suit your needs.

23. DNS Cloud does not guarantee that hosting the Website, access to it and any use of the Website files or of DNS Cloud services will not be disrupted, will be provided regularly or without interruption, will be safe and error-free, or will be immune from unauthorized access to DNS Cloud's computer systems, or from damage, breakdowns or malfunctions – including hardware, software or communication-line malfunctions to the Website – at DNS Cloud or any of its suppliers. DNS Cloud will not be liable – and you will have no claim, suit or demand against it – if any of the above occurs, but DNS Cloud will do its best to quickly fix any such malfunction.

The above will not apply if damage, breakdowns and malfunctions are caused by gross negligence or malice on the part of DNS Cloud. In such a case you will be entitled to compensation only for the direct damages caused to you and will not be entitled to compensation for

indirect or consequential damages. In any case, DNS Cloud's liability will not exceed the monthly fee you paid

to DNS Cloud in the six months preceding the damage event. You declare and confirm that this limitation of liability is the result of an allocation of risks between the parties and that it is reasonable and acceptable considering the terms of the engagement and its amount.

Termination and Breaches

24. Each of the parties, both DNS Cloud and the Customer, may notify the other of its wish to end the engagement, for any reason or without reason, with 30 days' prior notice to the other party, unless explicitly stated otherwise in the Order Form.

25. If the Agreement is terminated for any reason, this will not derogate from your obligation to pay DNS Cloud the fee for the period in which it provided you with services. DNS Cloud may withhold the release of the Website's files, content, data, backups and domain name until full payment of the fee owed to it by the Customer, and the Customer will have no claim in this regard.

26. If DNS Cloud finds, to the best of its judgment or according to a notice sent to it, that the content of the Website is contrary to this Agreement, or that you have committed a fundamental breach of this Agreement, or that you have misused a service DNS Cloud provided to you, or used it contrary to the Agreement or the law, it may act in any or all of the following ways – in addition to any other right granted to it under this Agreement or any law:

26.1 Cancel this Agreement and immediately remove from the Computer the Website, in whole or any part of it that breaches this Agreement (where possible), or block access to the Website or any part of it, without prior notice.

26.2 Immediately cancel any service DNS Cloud provides to the Customer.

26.3 If DNS Cloud receives a request from a third party who has proven to DNS Cloud's satisfaction that its rights were infringed by content on the Website, DNS Cloud may, in addition to the above, give the requester the Customer's contact details and additional information so that the Customer and the party claiming infringement can settle the matter directly between them. See also the Privacy Policy appended to the Agreement for more information on the use of personal information by DNS Cloud.

26.4 In any case, DNS Cloud will disclose your details and any other information about you if it receives a court order requiring it to do so. In addition, DNS Cloud may disclose your details and any other information about you at the request of any state authority, at its discretion.

26.5 Without derogating from the above, the following actions will also entitle DNS Cloud to act as described in this chapter:

26.5.1 Sending chain letters, "spam" or bulk commercial email to recipients who did not explicitly ask to receive it (Spam).

26.5.2 Any act or omission that may harm DNS Cloud customers, suppliers and business partners in particular.

26.5.3 When purchasing shared hosting services – performing actions that cause, or may cause, excessive use of the resources of the Computer hosting the Website, including excessive use of CPU or memory resources, or any other use DNS Cloud considers, at its discretion, to be unreasonable use of its systems or resources. Without derogating from the generality of the above, all of the following, among others, will be considered unreasonable actions, unless approved in advance and in writing by DNS Cloud and agreed between the parties in the Order Form, such as where DNS Cloud provides ancillary services to the Customer's own servers / VPS –

  • CPU usage – usage exceeding 25% of the Computer's processing power for more than 90 seconds;
  • Physical memory (RAM) – usage exceeding 256MB;
  • SQL – running complex SQL queries whose run time exceeds 15 seconds;
  • Hard disk – performing IO-intensive operations;
  • Bandwidth – using bandwidth higher than 10MB for more than one minute;
  • Concurrent active connections – more than 20 concurrent active connections per single user.
  • Processes – more than 20 concurrent processes per single user;
  • Threads – more than 20 concurrent threads per single user;
  • Running unsupervised standalone applications, such as IRC servers or bots;
  • Running software, websites or protocols intended for file sharing (P2P);
  • Running browser-based or external-software multiplayer game servers;
  • Uploading archive files (ISO/ZIP/TAR) larger than 250MB per file;
  • Running an advertising media campaign on a shared server;
  • Uploading more than 200,000 files to a single account.

26.5.4 DNS Cloud may, at its discretion, warn you and display a message informing you that you have reached the usage limit of the DNS Cloud resources allocated to you, but it is not obliged to do so.

26.5.5 Performing actions that harm, or may harm, the stability of the DNS Cloud systems used to provide the Services or DNS Cloud's ongoing operations.

26.5.6 Exceeding the traffic volumes included in the hosting plan agreed between the parties.

26.5.7 Cancellation of a transaction – the Customer may notify DNS Cloud of its wish to cancel the Terms of Use and receipt of the Services within 14 days, by submitting a written notice and request on the website, as set out in this regard in the Israeli Consumer Protection Law, 5741-1981. In such a case, DNS Cloud will stop charging the Customer from the day DNS Cloud stopped providing services to the Customer and/or, if the Customer paid DNS Cloud amounts in advance, DNS Cloud will refund the Customer the amounts for the proportional part of the months in which DNS Cloud did not provide the Services.

26.5.8 No proportional refund will be made for services paid in advance for a long term, such as, but not limited to, SSL, website hosting space, cloud services, hosting services, and internet addresses (domains).

27. Indemnification – You undertake to indemnify DNS Cloud, its employees, managers or anyone on its behalf for any damage, loss, loss of profit, payment or expense caused to them – including attorney fees and legal expenses – as a result of breach of your obligations under this Agreement or breach of any law.

28. Intellectual Property – The intellectual property rights in the DNS Cloud systems used to provide the Services belong solely to DNS Cloud, or to third parties who granted DNS Cloud usage rights. This engagement does not grant the Customer any rights in these systems. If DNS Cloud installed on the Website or on the Computer any application it developed or holds rights in (including a search engine) as part of providing the Services, it hereby grants the Customer a non-exclusive license to use the application on the Website during the term of the engagement only. You undertake not to copy, distribute, transfer or grant rights (including sub-licenses) in any such application. This engagement does not grant DNS Cloud any intellectual property rights in the Website or in the Customer's content.

Each of the parties will remain the sole owner of its trademarks, and nothing in this Agreement transfers any of the intellectual property rights of either party to the other party.

29. Privacy and Databases – DNS Cloud makes sure to act at all times in accordance with the Israeli Privacy Protection Law, 5741-1981, including the Privacy Protection Regulations (Data Security), 5777-2017. To the extent the Website or DNS Cloud content includes personal information or databases, DNS Cloud will not make any independent use of them for its own needs, but will process them solely for the purpose of providing the Services.

Please note – if the Website includes databases containing personal information (such as personal information about your customers, suppliers, employees, etc.) – you must inform DNS Cloud of this, so that DNS Cloud can implement its information-security obligations – which apply to DNS Cloud when it holds its customers' databases while providing them with website hosting services (in addition to the obligations that apply to the Customer as the database owner). You must inform us of the number of databases, their names and the security level that applies to them. This report is also required by DNS Cloud, among other things, in order to report to the Privacy Protection Authority about databases held by DNS Cloud.

In addition, the use of any personal information DNS Cloud collects as part of the engagement between the parties, including the details of the Customer's contact persons, will be in accordance with the Privacy Policy attached as an appendix to this Agreement.

Assignment of Rights

30. You may not assign, encumber, pledge or transfer your rights under this Agreement unless you have received DNS Cloud's prior written consent. DNS Cloud will not refuse to give its consent for unreasonable reasons. Among other things, a monetary debt of the Customer to DNS Cloud will be considered a reasonable reason for refusal. Any assignment, encumbrance, pledge or transfer contrary to this section will have no validity.

31. DNS Cloud may transfer, assign, pledge, encumber and grant a third party rights in its obligations and rights under this Agreement, in any case in which it organizes its activity or any part of it within a separate corporation, or upon a merger, or upon the sale of its business, in whole or in part, or for any other purpose – provided that the transferee assumes towards you DNS Cloud's obligations under this Agreement. You undertake to cooperate with DNS Cloud and to sign any document it requires to give effect to such transfer, assignment, pledge, encumbrance or grant of rights.

32. DNS Cloud may provide the Services under this Agreement, in whole or in part, through subcontractors or any other third party acting on its behalf.

General

33. A printout or output from DNS Cloud's computers will constitute evidence of the truth of its content in any dispute between the parties and in any proceeding before a judicial, administrative or other forum.

34. The Agreement is not intended to create, and does not create, employer-employee relations, agency, representation, partnership or brokerage relations between the parties, and the parties will not be entitled to any payment, consideration or rights under any law or custom that are not explicitly mentioned in this Agreement. Neither party to this Agreement will assume, approve or perform any obligation in the name of or on behalf of the other party, unless explicitly agreed otherwise.

35. The Customer will appoint a contact person who, until other written notice to DNS Cloud, will be authorized on behalf of the Customer to represent and bind it in this engagement. The Customer's contact person will be as set out in the Order Form. The Customer undertakes to update DNS Cloud in writing of any change in the identity of its contact person or their contact details.

36. This Agreement exclusively sets out everything agreed between the parties regarding DNS Cloud services, and no negotiation, consent, representation, undertaking, agreement or promise preceding the signing of this Agreement will be taken into account.

37. The Customer's address for the purpose of this Agreement is as set out in the Order Form. DNS Cloud's address appears in the heading of the Terms. Notices between the parties may be sent by registered mail, by courier and by email. Any notice sent by one party to the other by registered mail will be deemed to have reached its destination three days after being delivered for mailing. Any notice delivered by courier will be deemed to have reached its destination at the beginning of the first business day after its actual delivery, subject to written confirmation of delivery. Any notice delivered by email will be deemed to have reached its destination at the beginning of the first business day after it was actually sent.

38. Changes to the Terms – Since the services DNS Cloud provides develop and change frequently and much business experience is gathered in connection with them over time, DNS Cloud may change the provisions of the Agreement from time to time. The new terms of the Agreement will apply to you after renewal of the Services you ordered. Where possible, and if material changes are made to the terms of the Agreement, a notice will be published on the home page of the website. Continued use of the Services after the date of amending the Agreement indicates your consent to these amendments.

39. Confidentiality – The parties to this Agreement undertake that they, their employees and representatives will keep in complete confidentiality and refrain from disclosing in any way, directly or indirectly, themselves or through others, any professional, commercial or other information that is not public knowledge, in connection with the other party's activity to perform this Agreement, or any information transferred within its framework.

Each party will refrain from making any use of the other party's professional or commercial knowledge or information, except for the purpose of performing its obligations under this Agreement, enforcing it, or if disclosure of the information is required by law or at the demand of a competent authority. This section will not apply to information that is public knowledge or that became known other than through a breach of this Agreement.

40. Governing Law and Jurisdiction – This Agreement is governed solely by the laws of the State of Israel. Exclusive jurisdiction regarding any dispute arising from these Terms, the Order Form or DNS Cloud services is vested in the competent court in the Tel Aviv-Jaffa district, Israel

This appendix explains the privacy policy at DNS Cloud regarding personal information about its customers and their contact persons, including how DNS Cloud uses personal information provided to it by its customers or that it collects while providing the Services.

1. Collection of Personal Information about DNS Cloud Customers

1.1 DNS Cloud will collect from the Customer personal information necessary for providing the Services, including the personal details and information required in the Order Form (such as the Customer's details, if it is not a corporation, and the details of its contact persons – which may include names, ID number and contact details such as addresses, phone numbers and email addresses), as well as any additional operational information required to provide the Services. DNS Cloud will collect additional information in any correspondence or contact with the Customer, including when the Customer contacts DNS Cloud customer service.
