How do you check whether a domain name is available?
You can check whether a domain name is available using the query system on the website. However, the domain name registry is managed by the relevant registry operators. You declare and confirm that the search results in the query system itself do not indicate the existence or absence of any right of yours or of any other party in any domain name. Thus, even if you checked and found through the query system that the name is available, it may have been registered earlier or at the same time by a third party, or the domain name registry may not have been updated in time by the relevant registry operator. Likewise, even if according to the query system a domain name is still registered in your name despite your not having met the renewal conditions set forth in this agreement, the query system may not yet have been updated.
Accordingly, you declare and confirm that DNS Cloud cannot guarantee that the domain name you requested to register based on the query system is indeed available and can be registered, or that the listing of your name as the holder of rights in the domain name according to the query system indicates your rights therein. Only DNS Cloud's confirmation of the registration or renewal of the domain name you requested to register or renew shall constitute evidence of the registration or renewal of the name. Even if you checked and found through the query system that the name is available, it may have been registered earlier or at the same time by a third party, or the domain name registry may not have been updated in time by the relevant registry operator.

If DNS Cloud exercises its right under this section, and if you do not contact DNS Cloud to pay for and renew the domain name before the end of the aforementioned thirty (30) day period, you agree that you have waived the domain name and that you transfer all rights you may have had in the domain name to DNS Cloud.
After the aforementioned thirty (30) day period, you agree that DNS Cloud may:
(1) delete the domain name at any time thereafter, or (2) pay the registration fee to the registry operator or alternatively allow it to remain registered, and DNS Cloud may register itself or a third party as the holder of the domain name in the WHOIS database and point the domain name to name servers (DNS) and/or IP ) designated by DNS Cloud, or (3) put the domain name up for auction or alternatively sell the domain name, in which case you waive all rights to and holding of the domain name.
Transfer of Rights in a Domain Name
You may transfer to a third party ("the Transferee") all of your rights in a domain name that you registered through DNS Cloud, by notifying DNS Cloud of your wish to do so. The transfer will take effect and the registration will be changed accordingly by Domain The Net only subject to the following cumulative conditions: (1) DNS Cloud has received written notice and/or notice via the website, insofar as such an option exists, of your wish. (2) The payments for registration of the transferred domain name have been paid to DNS Cloud to its satisfaction, and DNS Cloud is not aware of any impediment, under any agreement or law, to carrying out the transfer; (3) The Transferee has confirmed its consent to the terms of this agreement or the agreement in effect on the website at the time of the transfer, as well as to the terms of the agreements applicable at the registry operator for the type of the transferred name. DNS Cloud reserves the right to require any additional document, including a signed agreement between the parties in a form to be determined by it, certified by a notary or attorney, at its sole discretion. As long as these conditions have not been met, the registration will remain as is, subject to payment of the renewal fees, and DNS Cloud will bear no liability whatsoever arising from the registration not being changed.
Granting Rights to Use a Domain Name
If you have granted a third party rights to use a domain name registered in your name, this will not derogate from your sole responsibility towards DNS Cloud and towards the registry operators of the type of domain name registered in your name to fulfill all of your obligations under this agreement, unless you have transferred all of your rights in the domain name to a third party as stated in the previous paragraph. In particular, but without derogating from the generality of the foregoing, you will bear sole responsibility for paying all amounts for the registration, holding and renewal of the domain name, as such amounts may be from time to time. Should DNS Cloud be found liable in any way for the third party's activity in the domain name, or suffer damage due to such activity, you will be obligated to fully indemnify or fully compensate DNS Cloud, as applicable.
Transferring Management of a Domain Name to DNS Cloud
You have the right to transfer the management of your domain name to DNS Cloud (registrar transfer). To do so, you must submit a request to transfer or renew the domain name in the designated place on the DNS Cloud website. You must submit the request yourself or through the person you identified at the time of registration as your authorized representative, whose details are held by DNS Cloud. Your request will not take effect until DNS Cloud has confirmed its receipt in a notice sent to you by email.
If you wish to transfer the holding rights in the domain name at the same time as changing the domain name registrar, you will be required to provide DNS Cloud, in addition to the confirmation mentioned above, with one of the following documents: (1) a valid agreement between the parties regarding the transfer of the holding rights in the domain name; (2) a final decision of a recognized body authorized to resolve domain name disputes; (3) a court order.
Prior to receiving the domain name registrar change service, you undertake to pay DNS Cloud a handling fee for carrying out the change, as may be in effect from time to time. A change of domain name registrar will be made only at the request of the domain name holder, as registered in the domain name registration system in accordance with the registry operators' guidelines. You declare that you have full authority, as the domain name holder, to initiate the transfer of the domain name's management to DNS Cloud, or that the domain name holder has granted you full authority to carry out such a transfer. DNS Cloud may, at its sole discretion, require you to present documents proving that the requester was granted full authority to submit the request. DNS Cloud may reject a request to transfer management of the domain name to it if: (1) the request was submitted before 60 (sixty) days have passed since the date the domain name registration request was submitted to the original domain name registrar; (2) in the cases detailed in the UDRP for domain names with a generic extension (gTLDs) or in the cases detailed in the specific dispute resolution policy of the domain name's extension; (3) if a receivership order or liquidation order is pending against the domain name holder; (4) when there is a dispute regarding the identity of the domain name holder; (5) in any case where changing the domain name registrar would be prohibited by any law. By submitting the request to change the domain name registrar, you declare that you have checked and found that none of the restrictions detailed above apply. Payment for carrying out the domain name registrar change, if any, will not be refunded; however, DNS Cloud may, at its sole discretion, apply the payment to an additional request submitted by you to change the domain name registrar for another domain name.
Upon the successful completion of the transfer of the domain name's management to DNS Cloud, you will be bound by the terms of this agreement. In the case of a registrar transfer of a domain name with a generic extension (gTLD) or other extensions where the registry operator has such a requirement, the domain name's registration expiry date will automatically be extended by one year. For a domain name with a generic extension (gTLD), the registration expiry date will be extended in this way only if the domain name's registration period after the extension does not exceed ten years.
